DMCA Policy

Chicken Asparagus respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Chicken Asparagus service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Chicken Asparagus site by completing the following DMCA Infringement Notice and delivering it to our Designated Copyright Agent.

Upon receipt of the Notice as described below, Chicken Asparagus will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Your DMCA Infringement Notice must include substantially the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest;
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
  3. Identification of the URL or other specific location on the Chicken Asparagus Site where the material that you claim is infringing is located;
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Designated Copyright Agent:

  • Your physical or electronic signature;
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
  • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content;
  • Your name, address, telephone number, and email address;
  • A statement that you consent to the jurisdiction of the federal court in the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Chicken Asparagus may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notification is received by the Designated Copyright Agent, Chicken Asparagus may send a copy of the counter-notification to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at Chicken Asparagus's sole discretion.
